SKILLS TRAINING ON FIRE PREVENTION AND FIREFIGHTING AND CERTIFICATION THEREFOR

DEPUTY PRIME MINISTER, MINISTER OF INTERIOR

-        Having seen the Constitution of the Kingdom of Cambodia

-        Having seen Royal Decree No. NS/RKT/0913/903 dated September 24, 2013, on the Appointment of the Royal Government of the Kingdom of Cambodia

-        Having seen Royal Kram No. 02/NR/94 dated July 20, 1994, promulgating the Law on Organization and Functioning of the Council Ministers

-        Having seen Royal Kram No. NR/RKM/0196/08 dated January 24, 1996, promulgating the Law on Establishment of Ministry of Interior

-        Having seen Royal Kram No. NS/RKM/0613/007 dated June 03, 2013 promulgating the Law on Fire Prevention and Firefighting

-        Having Sub-decree No. 109 ANK.PK dated August 19, 2015 promulgating the Law on Organization and Functioning of the Ministry of Interior

-        Having Sub-decree No. 131 ANK.PK dated August 18, 2017, Conditions and Methods on Fire Prevention and Firefighting

-        Based upon the necessity thereof

DECIDES

Clause 1:

The purpose of this Prakas is to raise the awareness on fire prevention and firefighting to producers, traders and transporters of fuel, inflammable and explosive substances within the Kingdom of Cambodia.

Clause 2:                                                                                

The goal of this Prakas is to determine Skills training on fire prevention, firefighting and certification therefor to producers, traders and transporters of fuel, inflammable and explosive substances within the Kingdom of Cambodia.

Clause 3:

The scope of this Prakas covers producers, traders and transporters of fuel, inflammable and explosive substances within the Kingdom of Cambodia.

Clause 4:

The General Commissariat of National Police shall have the competency to provide Skills Training on Fire Prevention and Firefighting and to issue a certificate to producers, traders and transporters of fuel, inflammable and explosive substances.

The General Commissariat of National Police shall transfer its duty of Skills Training on Fire Prevention and Firefighting to Fire Prevention and Firefighting Police, which shall be in charge.

Clause 5:

A responsible person at targets for production, trading and transportation of fuel, inflammable and explosive substances shall apply for Skills Training on Fire Prevention and Firefighting at the General Commissariat of National Police or Municipal/Provincial Police Commissariat at every working-hour.

Clause 6:

The General Commissariat of National Police shall issue a certificate to the owner or a responsible person at targets for production, trading and transportation of fuel, inflammable and explosive substances, that successfully complete such Skills Training on Fire Prevention and Firefighting within 15 (fifteen) working days after completion.

Clause 7:

Producers, traders and transporters of fuel, inflammable and explosive substances shall obtain a certificate certifying Skills Training on Fire Prevention and Firefighting from the General Commissariat of National Police as specified in the sample certificate attached to this Prakas.

Clause 8:

The certified person shall request a duplicate of the certificate in the case of any loss, damage or default form of origin of a certificate from the General Commissariat of National Police or Municipal/Provincial Police Commissariat.

Clause 9:

Producers, traders and transporters of fuel, inflammable and explosive substances who produce, trade and transport fuel, inflammable and explosive substances without a certificate on Skills Training on Fire Prevention and Firefighting issued by the General Commissariat of National Police, shall be receive a penalty as stated in Article 20 and 21, Chapter 5, Sub-decree No 131ANK.PK dated August 18, 2017, Conditions and Methods on Fire Prevention and Firefighting.

Clause 10:

Secretary-General of General-Secretariat of Ministry of Interior, the General Commissioner of National Police, Director of Central and Public Order Department, Director of Fire Prevention, Firefighting and Rescue Police Department, all related Department Directors, Governors of municipalities/provincial Police Commissariat shall implement this Prakas from the date it is signed.
